Developer Terms and Conditions      

These Developer Terms and Conditions (“Terms”) govern your use of the Arango product offering(s) (the “Arango Offerings”) for non-production developer use and form a binding agreement between you and ArangoDB, Inc. and its affiliates (collectively “Arango”). By accepting these Terms or downloading, accessing and/or using the Arango Offerings, you represent you are authorized to bind your employer, and “you” means your employer throughout. Arango may update these Terms or the Arango Offerings at any time, by email notice or re-acceptance at login; continued use means you accept the changes.

1. Software License; Open Source Components

The Arango Offerings will be provided in binary, source, container, or SDK form for download, installation, or self-hosting (the “Software”), or as a hosted service (the “Service”). You may choose to access and use either the Software or the Service. Use of the Software is additionally governed by the Business Source License 1.1 and Arango’s Additional Use Grant, Change Date, and Change License, published at https://arango.ai/legal/arango-bsl-policy/ (the “BSL Policy”), which is incorporated by reference and controls over any conflict herein. Consistent with Section 2, your license excludes Production Use (as defined in the BSL Policy) absent a separate written agreement with Arango. The Software may also include open-source software under separate license terms; you may have broader rights thereunder, and nothing here further restricts such use. Distributed container images will include applicable license notices and source-code disclosures.

2. Use of the Arango Offerings

You may access and use the Arango Offerings solely for internal development, testing and evaluation purposes, and not in any production environment, live application, or SaaS deployment, or for any commercial, revenue-generating, or distribution purpose. You may specify a reasonable number of users who may use the Arango Offerings on your account (“Users”), and you agree to accept responsibility for all activities on the Arango Offerings performed by your Users. Additional terms may apply to Users that are added through the administrative account such as an acknowledgment that the administrator of the account has already accepted these Terms. You’re responsible for all activity by your designated Users. Use is subject to Arango’s Privacy Policy (https://arango.ai/legal/privacy-policy/). Unless you separately purchase technical or support services, Arango has no obligation to provide support or fix errors.

3. Restrictions. You may not, directly or indirectly:

  • Rent, resell, distribute, or act as a service provider for the Arango Offerings, or use them to build a competing product;
  • Reverse engineer, decompile, or attempt to access source code, or modify the Arango Offerings;
  • Remove proprietary notices or trademarks;
  • Introduce malicious code, screen-scrape/crawl, or run security, penetration, or load tests without Arango’s prior written consent;
  • Access another customer’s data, upload unlawful content, permit third-party access, or misrepresent your affiliation; or
  • Otherwise violate applicable law or use the Arango Offerings for an unauthorized purpose.

4. Intellectual Property; Data; Confidentiality

Arango owns all right, title, and interest in the Arango Offerings and all intellectual property rights therein; no license is granted beyond what’s expressly stated here. Arango may collect and use de-identified, log, and usage data from your use for any purpose. Any feedback or suggestions you provide (“Feedback”) may be used by Arango without compensation, and you assign all related rights to Arango. You will not disclose any non-public information about the Arango Offerings obtained through your use to any third party. Arango may disclose or remove your data as needed to comply with law or legal process.

5. Disclaimers; Limitation of Liability

THE ARANGO OFFERINGS ARE PROVIDED “AS-IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARANGO DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. ARANGO IS NOT LIABLE FOR ANY DAMAGES, DIRECT OR INDIRECT, ARISING FROM USE OF OR INABILITY TO USE THE ARANGO OFFERINGS.

6. Termination

Arango may terminate these Terms and your access and use at any time, for any or no reason, without liability. You may terminate on written notice. Upon termination, you must stop using the Arango Offerings and destroy any related confidential or proprietary materials and certify as such if Arango requests. Sections 4–7 survive termination.

7. General

Governed by California law (excluding conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods). You may not assign these Terms without Arango’s prior written consent. Notices must be in writing by email — to legal@arangodb.com (from you) or your account email (from Arango). Failure to enforce a provision is not a waiver; unenforceable provisions are severed without affecting the rest. These Terms are the entire agreement between the parties regarding the Arango Offerings.
